Denied Workers' Comp Claims Attorney in Peoria, Illinois

Was Your Workers’ Comp Claim Denied?

After going through the process of filing for workers’ compensation benefits in Illinois, you find out your claim has been denied. Do not give up or panic. It is not extremely uncommon for a workers’ comp or disability claim to be denied. In fact, many workers have to continue down the administrative process to obtain their benefits. If you have been denied workers’ comp benefits, it is very important that you obtain a lawyer if you already haven’t. It is recommended that you have experienced legal counsel from the beginning of your case.

Every workers’ comp case is different, and even if you think your denied claim means your situation is over, you should not stop here. There are many reasons why a claim is denied. Sometimes it is because the right information wasn’t provided. Other times it could be due to the insurance company. That is why it is so important after suffering an injury at work to seek a legal professional’s advice.

Let's Discuss Your Options

Do Not Give Up After a Denied Claim

So you get a call, and your employer’s insurance carrier tells you your worker’s compensation claim was denied. First of all, your employer is required to send you a letter in writing explaining why your claim was denied. Secondly, the road to benefits doesn’t stop here. An attorney can find out why you were denied and then help determine the next course of action in filing again.

Once all the information has been gathered for this next step, your case should be submitted to the IWCC (“Illinois Workers’ Compensation Commission”). You can appeal the denial and request a hearing before an arbitrator. Furthermore, you have to file a petition for the hearing (Application for Adjustment of Claim). There are time limitations and deadlines that must be met from the date of your injury. Generally, this is three years.

Having a seasoned workers’ comp lawyer handle a denied claim and appeal for you can sometimes make all the difference. Especially when you are injured and should be focusing on getting better rather than dealing with insurance companies, arbitrators, and legal issues on your own.
